These Website Terms of Use (“Terms”) govern access to and use of the Ascend Creative website at ascendcreative.net, including its pages, content, contact forms, newsletter subscription features and other functionality made available through the website (“Website”).
Please read these Terms carefully before using the Website. By accessing or using the Website, you acknowledge that you have read and understood these Terms and agree to comply with them.
If you do not agree with these Terms, you should discontinue use of the Website.
1. Website operator

In these Terms, “Ascend Creative”, “we”, “us” and “our” refer to Ascended Media OÜ.
2. Purpose of the Website
The Website provides general information about Ascend Creative, its creative services, capabilities, working approach, portfolio, case studies and other related content.
The Website is intended to introduce our work and allow visitors to:
learn about Ascend Creative and its services;
view selected portfolio work and case studies;
submit an enquiry through a contact form;
contact us using the published contact details; and
subscribe to the Ascend Creative newsletter.
The Website does not provide an online store, checkout system or facility through which services can be purchased directly.
3. No offer or automatic client relationship
Information presented on the Website is provided for general informational and promotional purposes.
Website content does not constitute:
a binding offer to provide services;
a binding quotation or price commitment;
professional, legal, financial or business advice;
a warranty that Ascend Creative will accept a particular project;
confirmation of availability; or
the creation of a client, agency, partnership, employment, fiduciary or other contractual relationship.
Submitting a contact form, sending an email, booking an introductory conversation or otherwise contacting Ascend Creative does not create a service agreement or require either party to proceed with a project.
A project relationship begins only when the relevant parties have agreed to the project in writing, such as by accepting a written proposal, statement of work, order confirmation or service agreement.
Any separate proposal, quotation or service agreement entered into between Ascend Creative and a client will govern the relevant project. Where these Website Terms conflict with a signed service agreement, the signed service agreement will prevail in relation to that project.
4. Permitted use
You may access and use the Website for lawful personal or legitimate business purposes, including evaluating Ascend Creative’s services and contacting us about a potential collaboration.
You must not use the Website:
in violation of any applicable law or regulation;
for fraudulent, deceptive, abusive or unlawful purposes;
to impersonate another person or misrepresent your identity or authority;
to transmit malware, malicious code or other harmful material;
to interfere with the security, integrity, availability or proper functioning of the Website;
to gain or attempt to gain unauthorised access to the Website, its server, databases or related systems;
to collect personal information about other Website users;

5. Contact form and enquiries
When submitting an enquiry, you agree to provide information that is accurate and not deliberately misleading.
You must not submit content that:

infringes another person’s privacy, intellectual property or other rights;
contains malware, harmful code or deceptive links;
contains confidential information that you are not authorised to disclose; or
is unrelated to a genuine enquiry or legitimate communication.
You remain responsible for the information and materials you submit.
By submitting an enquiry, you authorise Ascend Creative to use the submitted information to review and respond to your enquiry, assess a potential project, communicate with you and take reasonable steps connected with the requested communication.
The contact form should not be used to send highly sensitive personal data, passwords, financial account information, medical information, identification documents, trade secrets or other information requiring enhanced security.
Internet communications cannot be guaranteed to be completely secure. You should use an appropriately secure method if confidential materials need to be exchanged.
We are not required to accept, respond to or retain every enquiry.
6. Newsletter subscription
Newsletter subscription is voluntary.
By entering your email address and actively subscribing, you request and consent to receive Ascend Creative newsletters and related communications, which may include:
studio news and updates;
articles, insights and educational content;
portfolio and case-study updates;
information about services;
project availability;
invitations, announcements and occasional promotional communications.
You may withdraw your consent and unsubscribe at any time by using the unsubscribe link included in a newsletter or by contacting us at info@ascendcreative.net.
Withdrawing consent will not affect the lawfulness of communications or processing that occurred before withdrawal.
Unsubscribing from the newsletter does not prevent us from sending non-marketing communications that may be necessary in relation to an enquiry, existing project, legal obligation or other legitimate matter.
We do not guarantee that every newsletter will be delivered. Delivery may be affected by email filters, technical issues, incorrect addresses, third-party systems or other circumstances outside our reasonable control.

7. Intellectual property
Unless expressly stated otherwise, the Website and its original content are owned by or licensed to Ascended Media OÜ.
This includes, where applicable:
the Ascend Creative name and branding;
logos and visual identity elements;

written copy and editorial content;
photographs, videos, illustrations and graphics;
animations and interactive elements;
design systems and interface elements;
project presentations and case-study layouts;
downloadable materials;
source materials; and
the selection, organisation and presentation of Website content.
The Website and its content may be protected by copyright, trademark, design, database and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable and revocable right to view the Website for lawful personal or internal business evaluation purposes.
Without our prior written permission, you may not:

8. Portfolio work, client materials and third-party rights
The Website may display selected projects created for clients, collaborators or other third parties.
Logos, trademarks, company names, product names, photographs, interface designs and other materials connected with those projects may belong to their respective owners.
Their appearance on the Website:
does not transfer ownership or grant a licence to Website visitors;
does not necessarily mean that Ascend Creative owns every component shown;
does not imply endorsement of Ascend Creative by the relevant rights holder beyond the accurately described professional relationship; and
does not authorise visitors to reuse those materials.
Descriptions of project roles, services and outcomes are intended to provide context about Ascend Creative’s contribution. Project scopes, responsibilities and results may differ between engagements.
9. Accuracy of Website information
We aim to keep Website information accurate and useful. However, Website content may occasionally be incomplete, outdated, simplified or contain typographical or technical errors.
Services, capabilities, collaborators, project availability, processes, portfolio content and other information may change without notice.
We do not warrant that:

Portfolio examples, testimonials, case studies and descriptions of previous work do not constitute a guarantee that another client or project will achieve the same or similar results.
Any project-specific objectives, deliverables, responsibilities, assumptions and commitments must be set out in the applicable proposal or service agreement.
11. Testimonials
Testimonials displayed on the Website reflect the views and experiences of the persons or organisations attributed to them.
They are not guarantees of future performance or outcomes.
We may edit testimonials for spelling, grammar, formatting or reasonable length, provided that their substantive meaning is not materially changed.

15. Limitation of liability

Ascend Creative is not responsible for loss resulting from:

internet, hosting or communication failures outside our reasonable control; or
events beyond our reasonable control.
Nothing in these Terms excludes or limits liability:

Nothing in this section restricts any mandatory right a consumer or other person may have to bring proceedings in another competent jurisdiction or use an applicable statutory dispute-resolution procedure.
20. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where legally possible.
The remaining provisions will continue in effect.
21. No waiver
A failure or delay by Ascend Creative to exercise a right under these Terms does not waive that right.
A waiver is effective only if made clearly and in writing by an authorised representative of Ascended Media OÜ.
22. Entire website-use agreement
These Terms, together with the Privacy Policy and applicable Cookie Policy, constitute the general agreement governing use of the Website.
They do not replace any separate written agreement concerning creative services, project work, licensing, confidentiality, payment or other client-specific matters.
